A young surgeon, was broadsided by a drunk driver who ran a stop sign. The doctor was left with a fractured left elbow and permanent ulnar nerve damage which affected his ability to perform intricate surgical procedures. The doctor's estimated lost future wages were several million dollars. Since the drunk driver did not have any automobile insurance, an Uninsured Motorist (UM) claim was made against the doctor's own insurance company. We were able to reach a confidential settlement between the doctor and his insurance company through mediation.
A confidential settlement was reached in a bizarre case involving a Plaintiff who was accidentally shot by his friend. While being rushed to the hospital emergency room by his friend, they went through a red light and violently collided with another vehicle. The ammunition used in this incident was a 9-millimeter hollow point bullet which fragmented into numerous pieces upon impact with the Plaintiff's shoulder. Surgery was able to remove some of the larger fragments, however, numerous pieces of the bullet were permanently lodged in the bone and soft tissue. The Plaintiff sustained permanent injuries to his shoulder including nerve damage and limitations in range of motion of his right arm. He also sustained herniated discs in his back as a result of the car accident while on the way to the hospital. The parties reached a confidential settlement prior to trial.
In this case, the Plaintiff was an elementary school teacher when she sustained a brain injury following a high-speed crash caused by a drunk driver. Several witnesses to the accident observed the drunk driver traveling at approximately 100 miles per hour just before the crash. In addition to sustaining injuries to her back and shoulder, the Plaintiff sustained a closed-head injury or concussion in the accident. Her post concussive symptoms worsened in the days immediately following the accident causing her to lose consciousness, fall down and sustain additional concussions which worsened her initial brain injury. The Plaintiff had cognitive and linguistic deficits which prevented her from teaching her students. Despite extensive Occupational Therapy, Cognitive Therapy, Speech Therapy and Physical Therapy, she did not attain a full recovery. The Plaintiff was ultimately forced to give up her teaching job. Settlements were reached with the drunk driver's insurance company as well as the insurance company that insured the car in which the Plaintiff was riding in the amount of $255,000.00. The Plaintiff then made an Underinsured Motorist (UIM) claim against her own insurance company. A UIM arbitration hearing was held and the Plaintiff received a $305,000.00 gross arbitration award.
